The LEGAL INITIATIVES IN THE FIELD OF INFORMATION SECURITY (ON THE EXAMPLE OF RUSSIA)

Abstract

Currently, the world is undergoing serious information transformations, which have also affected the criminal environment. Thefts, robberies, frauds, thefts of vehicles, threats of murder, involvement in criminal activities of minors, driving to suicide confidently «stepped» from the streets into the information and telecommunications network of the «Internet». Criminals increase their activity every day, using more and more new achievements of science and technology. The global community needs to recognize the fact that criminal laws seriously lag behind the forensic characteristics of these crimes in the digital environment. Already today, attackers, using the encryption of the «Tor» browser, register with a fake VPN in RPG games, where they meet in virtual space as avatars in private rooms and enter into criminal conspiracies, exchange virtual currency, which is then exchanged for donations through several transactions, and then monetize. And this is just one of thousands of examples. It is clearly understandable that only a person who is deeply «immersed» in the specifics of such activity is able to understand this sphere of social relations. Special subjects of lawmaking are not able to reflect the problems and adjust the criminal and criminal procedural legislation accordingly. In this regard, mechanisms are needed to stimulate legal initiatives of professionally and right- active youth (young people).

The analysis of issues of rapidly digitalization of the world, concerning the need for legal initiatives to find a consensus on the rights and freedoms of all members of society, including the criminal law sphere to prevent new types of crimes, methods and approaches of their commission.
