PLACE OF POLYGRAPH IN CRIMINAL PROCEEDINGS

Polygraphs examination is used in criminal cases in Hungary since the late 1960s. In the beginning, the Hungarian legislation did not name or regulate the polygraph examination. The expert was the polygraph examiner, whose activities were subject to statutory provisions. The new Penal Procedure Act, which entered into force in Hungary in 2018, placed instrumental credibility examination of testimonies among the evidence acts. The polygraph is performed by an adviser. As in international practice, consent is required in Hungary for conducting a polygraph test. The result of the polygraph examination is recorded, which can be brought to court. The aim of the presentation is to show what the polygraph is suitable for and what the international practice is. The presentation will also take into account the potential of polygraph and the method`s concerns, for example the mistakes that can lead to the wrong direction.
